The present terms and conditions of sale are concluded on the one hand between the company Actuelle, SAS with a capital of 151,000 euros, whose head office is located at 111 avenue de Soulac, 33329 Le Taillan-Médoc and registered with the Bordeaux Chamber of Commerce and Companies under the number RCS 493 447 585, hereinafter referred to as “Actuelle”, and the company managing the website, and, on the other hand, by any individual or legal entity wishing to proceed with a purchase on the website Actuelle, hereinafter referred to as “the buyer”.


Article 1. The object

The present general conditions apply to all the orders relating to products put on sale via the Internet site

The general conditions of sale are governed by French law and can be modified at any time without notice. Consequently, the customer acknowledges being perfectly informed of the fact that his agreement concerning the contents of the present general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented.


Article 2. The price of the items

The prices of our products are indicated in euros including all taxes (VAT and other taxes applicable on the day of the order), except contrary indication and expenses of treatment and forwarding. Shipping costs are not included in the prices of the products.

All orders placed on our site are payable in Euros.

SAS Actuelle reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in effect at the time the order is validated and subject to availability on that date.

Priority reserve clause: The products remain the complete property of the company Actuelle until full payment of the price. In accordance with the provisions of Article L.121 19 of the Consumer Code, the customer will receive, upon delivery of his order, written confirmation of the price paid detailing the price of the items and the delivery charges to be paid by the customer.

As soon as you take physical possession of the ordered products, the risk of loss or damage of the products is transferred to you.


Article 3. Orders and customer commitment


To place an order, we put at your disposal the website 24/24h and 7/7d.

Before ordering, the buyer must create an account on the Actuelle account.

By validating his order, the customer acknowledges having read these general conditions of sale and expressly declares to accept them without reservation. All orders are final and cannot be cancelled. Actuelle reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of supply problems, or in the event of difficulties concerning the order received.

At the time of his first order, the customer must open an account and fill a form specifying certain obligatory fields so that his order can be taken into account. The customer agrees to provide accurate and complete information. The user name and password used to access our website are confidential and must not be disclosed to third parties. After clicking on the register button, the customer receives a confirmation of his registration by e-mail.

In application of the provisions of article 1369-2 of the Civil Code, the customer has the possibility, before the final validation of his order, to check the details and the total moment, to correct possible errors, before validating it to express his acceptance. After validation of the order, the customer receives an order confirmation email sent by the company Actuelle. The order is then considered final. In accordance with the provisions of Article L.122.1 of the French Consumer Code, Actuelle is entitled to cancel or refuse any order that is abnormal or placed in bad faith, or any order from a customer with whom there is a dispute over payment of a previous order.


Article 4. Payment and payment methods

The fact of validating your order implies for you the obligation to pay the price indicated.

We accept payment by credit card or PayPal, as well as gift cards and Actuelle assets. Are accepted the payment cards of the network CB, Visa, Eurocard/Mastercard, in Metropolitan France, DOM TOM and Europe. When ordering via the Internet, the customer communicates in a secure environment his banking data (sixteen-digit number and the expiry date appearing on the front of his bank card as well as the visual cryptogram numbers appearing on the back of his bank card).

The card is debited at the time of order confirmation. Any customs duties will be charged to the customer.

We inform you that in case of display of an erroneous price, obviously derisory, whatever the reason (computer bug, manual error, technical error…), the order will be cancelled, even in case of initial validation.


Article 5. Delivery method and shipping costs

We process and ship orders on business days, Monday through Friday, excluding holidays. Deliveries for France are made by the company DPD, delivery service with tracking, delivery without signature. Signature is required for home delivery only.

Deliveries to the European Union, the United Kingdom and Switzerland are made by the DelivengoEasy service of the Laposte company.

  • Deliveries in France

The company Actuelle offers the following delivery methods:

– Delivery in relay point: delivery within 24 to 48 hours after shipment of the order, for an amount of 3.90 euros without signature. Free from 60 euros of purchase.

– Delivery to the workplace: delivery within 24 to 48 working hours after shipment of the order, for an amount of 3.90 euros without signature. Free from 60 euros of purchase.

– Home delivery: delivery within 24 to 48 working hours after shipment of the order, for an amount of 5.90 euros without signature.

In order for these deadlines to be met, the buyer must ensure that he has provided accurate and complete information concerning the delivery address (such as street number, building number, staircase, access code, names and/or intercom numbers, etc.).

No dispute relating to the delivery itself is possible if the package appears to have been delivered, the register of the carrier being authentic.

The products are delivered to the delivery address indicated during the ordering process, within a period indicated on the order validation page. In the event of a delay in shipment, an e-mail will be sent to you to inform you of the possible consequences on the delivery time that was indicated to you. If the package is damaged upon pickup, please refuse it or notify us in order to obtain a refund in the event that one of the products is defective.

In metropolitan France, for any order greater than or equal to 60 euros TTC, shipping is free, except for home delivery, which is, in all cases, charged 5.90 euros TTC. For all orders under 60 euros including VAT, the buyer will be charged a flat rate for shipping costs, the amount of which varies according to the delivery method chosen, ranging from 3.90 euros to 5.90 euros.

Delivery times are given as an indication only; if they exceed 30 days from the order, the sales contract may be terminated and the buyer reimbursed. The company Actuelle can provide the buyer with the tracking number of the package by e-mail.

Article 6. Product information

The photographs illustrating the products are not part of the contract. Dimensions shown are for reference only and may vary. If errors are introduced, if the color or the packaging vary slightly, the responsibility of the company Actuelle can in no case be engaged.

  • Product availability

Our products are offered as long as they are visible on the site and within the limits of our available stocks.

In the event that one of the products ordered is not available in our stocks, we undertake to contact you by e-mail within 5 days from the date of your order in order to inform you of this and to indicate to you the time frame in which this product could, if necessary, be delivered. If among the ordered products, some are temporarily unavailable, we will propose you a refund.

Attention, some pieces can be sent after the usual shipping time, this information is in this case notified on the product sheet.

If one of the pieces that make up your order is affected by this delay, the entire order will be shipped at the same time.


Article 7. Right of withdrawal / return and refund

In accordance with the article L221-5 of the code of the Consumption, the deadline of retractation is of 14 days as from the day of the reception of the parcel (date on the follow-up being taken as proof). After this period, returns will not be accepted. The package must be returned within 14 days of the request for return, as evidenced by the postmark. Any package with a date stamp that exceeds 14 days will be refused.

Return conditions

You have 14 days from receipt of your order to return your items. After this period, returns will not be accepted. Damaged or unlabeled items will not be eligible for a refund, nor will accessories. Items on sale are at the customer’s expense.

  • How do I return my item (for orders placed in France)?

To return your items, please send us an email to the following address:

We will process your request as soon as possible (working days) and will send you a return label (except for items on sale) to print and place in your package so that you can send us the desired items.

Prepare your package

Place your items in their original packaging along with the return slip in the package.

Don’t forget to indicate the reason for your return and the number of items.

Place your item in the original packaging and slip the return form inside so that our team can proceed with the refund within 48 hours, working days.
Then stick the return label received by mail with the delivery address already filled in and drop your package in a DPD relay point of your choice.


  • How do I return my item (for orders placed in Europe and internationally)?

Return shipping costs are at the customer’s expense for all international orders. If the country in which you placed your order is eligible for the return of the ordered items (see https://www.actuelle .fr/livraison/), the procedure is the same as for France. Place your item in the original packaging and slip the return form inside so that our team can proceed with the refund within 48 hours, working days.
Then, write the address of our premises directly on the parcel (111 Avenue de Soulac, 33320 Le Taillan-Médoc, FRANCE) and deposit your parcel in the post office of your choice.

We do not do exchanges, so if you want to recommend a product, you will have to reorder it on our website, after asking for a refund of your item.

Shipping costs are not refundable.

We recommend that you return your order by tracking.

Returns are to be made in their original condition (new, with packaging, bar code, unworn, unwashed, labels still attached to the product). In this context, your responsibility is engaged. Any damage to the product may defeat the right of withdrawal.

Upon receipt of the package, the company Actuelle will judge the perfect condition of the returned goods. If the return is refused by the company Actuelle, the articles will be returned to the customer at the expense of the company Actuelle without the customer being able to demand any compensation or right to a refund.

  • Return of a defective or non-conforming item at your request

In the event of an error during the preparation of the order, Actuelle will be responsible for the return shipping costs. A return label will then be sent to the customer so that he can send back the items concerned by this error.

  • Return of a damaged package

In case of receipt of a package damaged during transport, it is recommended to the customer to open the package in the presence of the deliveryman to check the condition of the items. In case of damage to the items, the customer must refuse the package. The latter will then be returned to Actuelle. The customer will then be contacted by the seller by e-mail or by phone. If the customer accepts a damaged parcel, it is imperative to make reservations with the deliveryman: the damage observed and/or possibly the missing items must be indicated on the tracking form, in addition to the customer’s signature. Without reservation, Actuelle will not be able to take into account possible future claims. In case of damage during transport, any protest must be made to the carrier within 3 days of delivery.

  • Repayment period

Upon receipt of your return, we will proceed with the online refund of the returned product(s). The maximum time for a refund is 48h to 72h working days after receipt of the package in our premises.

The method of payment is the one used during the payment of your order. It is not possible to change the payment method for the refund of the order. Actuelle will not be responsible for refunds on expired payment methods.

The refund of an order paid with a gift card or a credit will be automatically refunded as a credit.


Article 8. Warranties and limitations of liability

The liability of SAS Actuelle with respect to any product purchased on the site is strictly limited to the purchase price thereof.

SAS Actuelle, in the online sales process, is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, service interruptions, or other involuntary problems. Buyer acknowledges that it assumes all risks associated with any content downloaded or otherwise obtained through the use of the website and agrees that it is solely responsible for any damage to its computer system or loss of data that results from the download of such content.

All our products benefit from legal guarantees of conformity, as long as they have been used normally and that the maintenance advice has been followed. This allows the customer to return, free of charge, the products delivered defective or not in conformity.


Article 9. Intellectual Property

The texts, comments, images, photos, illustrations, reproduced or present on the website are reserved under the copyright. As such, and in accordance with the intellectual property code, any total or partial reproduction is strictly forbidden without the written consent of the company Actuelle.


Article 10. Personal data

As a merchant, we collect a certain amount of information necessary to process orders. All this information is treated with the utmost confidentiality. The information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide this information will result in the non-validation of the order. In accordance with the law “informatique et liberté” of January 6, 1978, you have the right to access, rectify, modify or delete data concerning you. Article 11. Applicable law – Jurisdiction – Mediation

The present general conditions of sale and the contractual relations between SAS Actuelle and the buyer are subject to French law.

Any dispute relating to the interpretation, execution or breach of these general terms and conditions of sale and/or the contractual relations between SAS Actuelle and the buyer shall be submitted to the sole jurisdiction of the French courts, notwithstanding multiple defendants and/or third party claims, even for emergency proceedings or protective proceedings in summary proceedings or by petition.

The competent court in case of dispute will be that of the place of residence of the defendant.

The buyer is informed of the possibility of resorting to a conventional mediation procedure in the event of a dispute arising from an online purchase, if such a dispute could not be settled by means of a prior complaint submitted directly to SAS Actuelle.
